Construction &
Government
Contract Law

We handle the full life cycle of a construction project from start to finish, from project planning, to completion and resolution, including avoidance of project disputes.

Recently, we have been advising clients on Covid-19 protocols, including drafting appropriate contract language regarding epidemics and pandemics.

Construction Litigation

We are experienced construction litigators with over 40 years of experience. We work hand-in-hand with developers, owners, builders, general contractors, subcontractors, third-party vendors, etc, to provide counsel and litigation of claims, including all aspects of scheduling (delay, disruption, loss of productivity), structural engineering, civil engineering, mechanical and electrical engineering.

Barbara Werther has experience in the following categories:

  • Airports
  • Bridges and Tunnels
  • Buildings and Public Facilities
  • Dams and Waterways
  • Educational Facilities, Institutions, Recreation Facilities and Libraries
  • Hospitals and Health Care Facilities

Contract Drafting

Our practice focuses on construction litigation matters. We assist owners, developers and design/build contractors, general contractors, construction managers, major subcontractors and suppliers, and sureties and guarantors in all aspects of the construction process.

Separately, we represent developers and contractors in connection with drafting architect and construction contracts on projects including affordable housing, office building, multi-family projects, PPP, design-build projects, museums, theaters, condominiums, renovations and commercial tenant spaces.

Dispute Resolution

We help clients avoid claims in a cost-effective manner. We make it our priority to reduce the risk of extended litigation that can result in the loss of time, capital and resources needed to complete a project. We are highly skilled in resolving matters through arbitration, mediation and other forms of dispute resolution.

Dispute prevention and resolution is absolutely critical to any project. We are experts in risk mitigation strategies and advise our clients accordingly. Rather than reacting to an issue once it exists, we are proactive in our approach to preventing disputes and conflicts.

If litigation can be avoided, we find a way to do so by working hand-in-hand with all parties and seeking a positive and longterm resolution. However, if litigation is necessary, our lawyers have the credentials, reputation and background to argue your case effectively and successfully.

Barbara Werther is a trained mediator and arbitrator.

Government Contracts

In addition to our other specialties, our practice handles government contract claims for prime contractors against the federal government, for prime contractors against subcontractors, and for subcontractors against the prime contractor and government on pass-through claims. We have special expertise in real estate partnership disputes, overturning default terminations and in resolving eight figure claims on behalf of prime contractors and their subcontractors on federal infrastructure projects.
